Booking Terms and Conditions

Our Terms and Conditions are made up of several documents and your acceptance of one will confirm acceptance of the others. Please follow the links in this document and below where instructed.

General

1 Your booking may be for holiday or business purposes, however when you are visiting for business you are only permitted to use the property for your own accommodation and you must not conduct business, hold meetings or otherwise carry out business activities at our properties without agreeing this with us first in writing. This is an insurance requirement and we would need to notify them. The property must not be used for gatherings, such as weddings or parties or for business purposes (except by prior special arrangement). Please note also condition 3.

2 The property will not be available before 4pm on the first day of your booking and you must leave before 10am on your last day. We may be able to accommodate special requests if notified in advance. Sometimes it may be necessary to make a small charge for special requests. For instance, if a late checkout will require extra house keepers.

3 Excluding babies in cots, the number of people occupying the property and its grounds must not exceed the number shown on the Wild Garlic Stays website. You may invite an additional two guests to visit you during your stay, however they must not stay overnight. This is very important because our properties are prepared, furnished and equipped for the number of people specified and greater numbers cause damage and excessive wear and tear to vulnerable buildings. It is for this reason that we reserve the right to make a charge per person per day (whether or not they stay overnight) for each guest over the permitted limit, the charge being pro-rated on the total cost of your booking. If the property is used for business purposes, we reserve the right to make a further charge equivalent to three times the original cost of your booking. It is also a requirement of our insurers that we know who is at our properties at any given time and this information is important if there were to be an emergency.

4 Dogs are generally not allowed at our properties (of course, guide dogs are always welcome and whilst you do not need to tell us you are bringing your service dog, we would appreciate your letting us know in order that we can provide extra items for their stay). This said, you are welcome to contact us before making your booking to discuss this. If we are able, and it will not compromise any future guests, we will reserve the right to grant an exception to this rule. The exception will be granted in writing and we will make a charge to cover our increased cost of cleaning. We may also request a deposit (this does not apply to guide dogs for which there is no charge and no deposit required). We will notify you of at the time of booking. They must be kept off the furniture, not allowed into bedrooms and they must be under proper control. Under no circumstances must a dog be left at the property when you are not there. No other pets are permitted.

5 No fireworks, Chinese or sky lanterns (or other lights or illuminations which have naked flames) shall be let off, and drones shall not be operated. No candles are permitted to be lit inside any buildings. Electric vehicle charging through the standard 13A sockets in the property is not permitted. Electric bikes, electric scooters and similar items are not allowed onto any of properties, either in the grounds or in the buildings. Under no circumstances must they be brought onto our premises and they must not be charged. This also applies to vape devices and associated products.

6 Whilst the information in our Handbook and website is correct at the time of publishing, we reserve the right to change any of the prices, services, or other particulars contained in published information at any time before we enter into a contract with you.

Contract and warranties

7 Once we have accepted your booking and payment (whether in whole or in part), a contract has been entered into, upon these conditions which include your acceptance of our House Rules which can be found by reading the “staying In Our Buildings” website page here, and such contract is governed by English law. Payment of all required amounts when they are due is of the essence of the contract. This booking is on our terms and conditions which will be sent to you with our booking confirmation. If you do not accept them you may cancel your booking and claim a full refund within 7 days from when you made the required payment. Please ensure you have read and are happy with our house rules before booking. The house rules can be found at Staying In Our Buildings https://www.wildgarlicstays.co.uk/staying-in-our-buildings.

8 When you make a booking you warrant that you are over 18 years old and accept full responsibility for all persons who will use the property during the period booked and you have read and agree to all the Terms & Conditions including the privacy policy available at https://www.wildgarlicstays.co.uk/privacy-policy.

Bookings

10 Provisional bookings made by telephone will become firm provided we receive the amount due within the period agreed at the time of booking (usually two days).

11 If your stay starts within 8 weeks of the date you make your booking, you are required to pay the total price at the time of booking.

12 If your stay starts more than 8 weeks from the date you make the booking, you are required to pay a deposit of one third of the cost of your stay (or £100 per booking, if greater) at the time of booking.

13 We reserve the right to decide to charge or not charge a deposit. We will notify you at the time of booking.

14 Bookings must be for our normal booking periods and will not be for fewer than two nights or for more than three weeks. In the case of bookings for more than one week, we provide linen and towels but no cleaning for each successive week, but will only remake beds with the new linen if you ask for this one month before your holiday.

15 If you pay a deposit, the balance must be received at least 8 weeks before the beginning of the period booked. We do not undertake to remind you and if we do not receive the balance when due, we shall, with regret, cancel your booking and you will lose your deposit.

Payments

16 We accept Maestro (if issued in the UK), Visa, MasterCard and direct transfer. We may be able to accept other forms of payment (like American Express etc) and you will be notified of this at the time of payment or in advance if you contact us. All payments must be in sterling unless we have provided you with an option to pay in another currency. Only one voucher issued with a Handbook can be used as part payment for any booking.

Loss or damage

17 When you book, you agree to indemnify us against all loss and damage arising (including more than normally and reasonably anticipated amounts of cleaning) directly or indirectly to the property and its contents from any deliberate or negligent act or omission by yourself, or any person or animal accompanying you, and, without limitation of the foregoing to pay us forthwith upon written demand our costs in making good any such loss and damage and cleaning. Where we have to make a claim the amount involved will reflect the cost of making good damage to historic and architecturally important buildings and furniture. The cost may include work by specialist craftsmen using specialist materials.

Problems during your stay

18 If you have any issues concerning the property during your stay you should notify us immediately (The contact name and telephone number appears in the information sent with the confirmation of your booking and in the Building Information folder at the property). Wild Garlic Stays will not normally make any refunds in respect of complaints made after the customer’s departure from the property if the customer did not make the complaint or problem known to us during the stay. In considering any complaint we will take into account whether we have been given the opportunity to investigate it and the chance to put matters right.

Cancellation

19 If you cancel a booking for any reason, you must notify us in writing by email, or via another route which we have provided you with at the time of booking.
Once you have cancelled a booking the option to transfer the booking, as detailed in condition 21, will no longer be available.
If you notify us more than 180 days before the start date of your booking we will return to you any sums received by us less £30 administration fee.
If you notify us 180 days or less before the start date of your booking, then, save as provided in condition 20, the following cancellation charges will apply, from the date you informed us of the need to cancel.

-
180 to 56 days before start date: 10% of the total rental
-
55 to 42 days before start date: 50% of the total rental
-
41 to 29 days before start date: 75% of the total rental
-
28 days or less to start date or early departure: 100% of total rental and we will return to you any sums received by us less the appropriate cancellation charge. For the purposes of this condition 19, ‘start date’ or ‘start date of your booking’ means the start date of the original booking in cases where we have agreed that we will transfer your booking to a new date or building. If you wish to make a claim on your travel insurance for the cancellation charges and would like a statement for your insurance company please inform us and we will provide this for you. In addition, you will be responsible for any travel costs incurred by you in relation to the booking. We do not operate a cancellation insurance scheme and strongly recommend that you ensure that you have your own appropriate cover. We will charge a fee of £30 to reinstate any cancelled booking.

Bookings made through late stay availability and special offers will always attract a cancelation charge of 100%.

This means, if you would like to cancel a booking made 50 days ago, our cancelation charge would be 50% and we would return to you 50% of the total you paid for the booking. If you would like to cancel a booking in the 28 days before you arrive, our cancelation charge would be 100% and therefore no money would be returned to you.

20 If you notify us 180 days or less before the start date of your booking, we will endeavour to re-let the property. If we are successful in re-letting all or part of the period booked we will return to you any sums received by us from the re-letting up to the amount you paid for the period re-let (less £30 administration fee). To achieve a re-letting we reserve the right to re-let at a discount at our discretion. In the event that you would receive a greater sum under condition 19 than under this condition 20, condition 19 will apply.

21 We can in some cases transfer bookings to a new date or building for a charge of £30 for each property booked, plus any additional rent, at the rate set on the Wild Garlic Stays website, provided this is requested no fewer than 8 weeks before the start of the holiday.

22 We may cancel a booking at any time before it begins. We would expect to do this only for essential building work, Government-enforced closures or for some other reason unforeseen by us at the time your booking was accepted. In this unlikely event we shall refund in full all money received by us for the booking, but will not have any liability beyond this, and, without limitation of the foregoing, we will not have any liability for travel costs incurred by you in relation to the booking.

23 We accept no liability for any works or activity of any sort occurring on any premises adjoining or neighbouring our property, nor shall we be responsible for making any enquiries about the likelihood of, or providing any information to you about, any such works or activity.

Access

24 Anyone with our authority may have access during your stay. This is unlikely to happen, but if it does, we will give you as much warning as we can. There will be no need for you to stay in, since our Housekeeper can accompany the visitor.

VAT

26 At present, we are not VAT registered and our prices do not include VAT which is not payable. If our position changes and we are required to charge VAT, we reserve the right to amend our prices accordingly and without notice.
Limitation of Liability

27 Our liability to you and those accompanying you at the property is strictly limited to direct loss up to the amount paid by you on booking but this does not apply to our liability for:

a) death or personal injury caused by our negligence;
b) fraud or fraudulent misrepresentation on our part;
c) anything else for which liability may not at law be excluded.

We shall not be liable to you at all for any indirect or consequential loss, whether caused by negligence, breach of contract or otherwise.

We are also not liable to you for any noise or disturbance from neighbours or other activities outside the property (including agricultural, industrial and street noise).

28 We reserve the right to terminate a booking at any time if these conditions are not met in full.
